Withdraw from the Contract

Right of Withdrawal

The right of withdrawal applies exclusively to consumers, meaning natural persons acting for purposes outside their trade, business, craft or profession. Purchases made by individuals or entities acting in the course of their business or professional activity are excluded from the scope of consumer protection legislation and do not benefit from the statutory right of withdrawal.

Sealed food products (including olive oil, preserved vegetables, pasta and preserves) may only be returned if the original packaging remains intact and unopened. In accordance with Article 59 of the Italian Consumer Code, the right of withdrawal does not apply to sealed goods which have been unsealed after delivery and are not suitable for return for reasons of health protection or hygiene.

Return Costs & Return Procedure

Where the right of withdrawal is exercised, the Seller will reimburse all payments received from the Consumer, including the cost of standard delivery, within 14 days of being informed of the decision to withdraw from the Contract. The Seller may withhold reimbursement until the goods have been received or until the Consumer has supplied evidence of having returned the goods, whichever occurs first.

Unless otherwise agreed, the direct cost of returning the goods shall be borne by the Consumer, provided that the Consumer has been informed of this in advance. The goods must be returned securely packaged, preferably in their original packaging, so as to ensure that they are adequately protected during transit. The Seller reserves the right to inspect the condition of both the packaging and the goods upon receipt. If the goods are received damaged as a result of inadequate packaging, the Seller may deduct from the reimbursement an amount corresponding to the loss in value.

The Consumer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
